Declaration Under Penalty of Perjury for Non-Individual Debtor

An individual who is authorized to act on behalf of a non-individual debtor, such as a corporation or partnership, must sign and submit Declaration Under Penalty of Perjury for Non-Individual Debtors (Official Form 202) for the schedules of assets and liabilities, any other document that requires a declaration that is not included in the document, and any amendments of those documents. This form must state the individual's position or relationship to the debtor, the identity of the document, and the date.  Bankruptcy Rules 1008 and 9011.

Filing Requirements:


To File Electronically:

  1. Log into CM/ECF.

  2. Select [Bankruptcy >  Misc/Other].

  3. Enter the case number (e.g, xx-xxxxx).

  4. Select [Declaration Under Penalty of Perjury] from the event list.

  5. Skip the Joint Filing screen.

  6. Select the party filer.

  7. Browse to select the document (PDF file).

  8. Check the box to Refer to existing event(s); click  [Next]

  9. Select the category to which your document relates.

  10. Modify test as appropriate.

  11. Verify the final docket text; if correct, click [Next] to submit your document(s).

    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
