Notice of Override of Preferred Address Under Section 342(e)

11 U.S.C. 342(e)                          

Section 342(e) provides that a creditor may file with the court and serve on the debtor a notice of address that must be thereafter be used to give notice to the creditor in that case.  The court and debtor must use that address beginning [7 days] after receipt.

Filing Requirements:

  • Notice of Override of Preferred Address

  • Proof of Service

Step-by-Step Procedures:

  1. Log into CM/ECF.

  2. Select [Bankruptcy >  Notices].

  3. Enter the case number (e.g, xx-xxxxx).

  4. Select [Notice of Override of Preferred Address 342(e)] from the event list.

  5. Skip the Joint Filing screen. Court will select the attorney filer.

  6. Select the party filer. If the party is not listed, click on Add/Create New Party.

    Note:  The Attorney/Party Association screen may appear. If your party selection was correct, check the box to create an association.

  7. Browse to select Notice (.PDF file). Note:  The Proof of Service may be one PDF document or added as an attachment to this document

  8. Statement displayed "Add this new creditor address to the creditor matrix for noticing and select the Override Preferred Address Button". Click [Next]

  9. Modify the text as appropriate.

  10. Verify the final docket text; if correct, click [Next] to submit your document(s).

    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately emailed to all participants who receive electronic notification in the case.
