Withdrawal of Document

Filing requirements:

  • Withdrawal of Document (text entry only)

    Note:  When withdrawing only a portion of previously filed documents, type the title of each document being withdrawn in docket text. See Example below.

    Note:  The electronic filer will be responsible for informing all parties that are nonelectronic filers notice of the text entry withdrawal and a certificate of service will be filed.

Step-by-Step Procedure:

To File Electronically:

  1. Log into CM/ECF.

  2. Select [Bankruptcy >  Misc/Other].

  3. Enter the case number (e.g, xx-xxxxx).

  4. Select [Withdrawal of Document (Text entry only)] from the event list.

  5. Select the party filer.

  6. Select or De-select party association if applicable.

  7. You must Refer to the document being withdrawn.

  8. Modify the text as appropriate.

  9. Verify the final docket text; if correct, click [Next] to submit your document(s).

    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.

Court will:

  • Per CM Meeting 10/23/14: When filer is withdrawing only a portion of previously filed documents, have them type the title of each document being withdrawn in docket text, or CM to call and enhance the text.

  • If the withdrawal was filed electronically, terminate the document [Bankruptcy > Court Events > Terminate Document or Terminate Motion].

  • If the withdrawal removes a matter from the calendar,  send email to calendar clerk.

  • Calendar clerk will remove hearing from the calendar and will inform the Judge and her staff of the withdrawal.
