Computation and Chapter 11 Ballots

The plan proponent is responsible for collecting, tabulating, and reporting the ballots. 

Upon expiration of the last day to cast the ballots, compile them on the Chapter 11 Computation form. At least five (5) days (excluding weekends and holidays) prior to the scheduled confirmation hearing file the form and ballots using the court’s CM/ECF filing system.

A copy of the tabulation form should be served upon:

-The United States Trustee

-The Creditors Committee Members (if any)

-The Attorney for the Creditors Committee (if any)

-The Debtor (if the Debtor is not the plan proponent)

-The Attorney for the Debtor (if the Debtor is not the plan
 proponent)

and submit proof of service to the court.

TO SUMMARIZE:

Five (5) days (excluding weekends and holidays) before the confirmation hearing, file with the Court:

  • Original Ballots

  • Completed Tabulation Form

  • Proof of Service (serve above parties with tabulation form)


To File Electronically:

  1. Log into CM/ECF.

  2. Select [Bankruptcy >  Plan].

  3. Enter the case number (e.g, xx-xxxxx).

  4. Select [Computation and Chapter 11 Ballots] from the event list.

  5. Skip the Joint Filing screen.

  6. Select the party filer.

  7. Browse to select the Ballot Summary (.PDF file).

  8. Verify the final docket text; if correct, click [Next] to submit your document(s).

    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
