Filing Requirements:

By General Order dated November 27, 2017, the United States Bankruptcy Court for the District of North Dakota will require the use of a local Chapter 13 plan form adopted in accordance with Fed. R. Bank. P. 3015(c) and 3015.1 for any Chapter 13 plan or amended Chapter 13 plan filed on or after December 1, 2017.

* IF AMENDED PLAN IS FILED 21 DAYS PRIOR TO CONFIRMATION HEARING:

* IF AMENDED PLAN IS FILED LESS THAN 21 DAYS PRIOR TO CONFIRMATION HEARING
  • Movant will file and serve the amended plan along with a 21 day notice of the time fixed for filing objections to the amended plan.
  • Court will issue Order Rescheduling Confirmation hearing to include a 21 day notice of the time fixed for filing objections to the amended plan
 
  • Movant to serve Order Rescheduling Confirmation and Amended Plan.

 


To File Electronically:

  1. Log into CM/ECF.

  2. Select [Bankruptcy >  Plan].

  3. Enter the case number (e.g, xx-xxxxx).

  4. Select [Amended Chapter 13  Plan] from the event list.

  5. Skip the Joint Filing screen.

  6. Select the party filer.

  7. Does this amended plan include the certificate of service (y or n), click [Next]

  8. Browse to select the Amended Chapter 13 Plan (.pdf file).

    Note:  The Proof of Service and supporting documents may be added as attachments to this document.

  9. Select the requests for relief that were NOT included in the previous Chapter 13 Plan and NOW are included in the Amended Chapter 13 Plan.  Click [Next] if none of these requests are new included in Amended Plan)

  10. Refer to the most recent plan being amended.

  11. From first drop down menu, select whether this is First, Second, or Third Amended Plan.

  12. Modify the text as appropriate, if applicable.

  13. Verify the final docket text; if correct, click [Next] to submit your document(s).

    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately emailed to all participants who receive electronic notification in the case.
