Motion for Hardship Discharge

(Chapter 12 and Chapter 13)

Filing Requirements:

• Motion for Hardship Discharge.

• Court will enter Order and Notice setting dischargeability deadline and hearing date.  

• Attorney for the Debtor to serve Motion and Order on all creditors.

• Proof of Service (file after Court issues Order and Notice).

• Prior to Discharge being entered by the Court, it is required that the debtor(s) file:

• • Certification of Completion of Financial Management Course - Chapter 13 (cases filed on or after 10/17/05)

  • Certification of Domestic Support Obligations - Chapter 12 and 13 (cases filed on or after 10/17/05)

To File Electronically:

1. Log into CM/ECF.

2. Select [Bankruptcy >  Motions/Applications].

3. Enter the case number (e.g, xx-xxxxx).

4. Select [Hardship Discharge] from the event list.

5. Skip the Joint Filing screen.

6. Select the party filer.

7. Browse to select the motion (.PDF file).

8. Modify the text as appropriate.

9. Verify the final docket text; if correct, click [Next] to submit your document(s).
   
   Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
