Overview of Transcript ProcedureLast Updated: January 2020NOT COMPLETED - CKAt the September 2007 session, the Judicial Conference adopted a policy regarding electronic availability of transcripts of court proceedings. Earlier, at its September 2003 session (JCUS-SEP 03, pp. 16-17), the Judicial Conference approved procedures (revised at its March 2007 session) to implement the Judiciary's privacy policy (now reflected in F.R.B.P. 9037) as it applies to electronic availability of transcripts.
1) Transcript filed by court reporter/transcriber: [Court Reporter/Transcriber> Transcript] Access to the transcript via PACER is restricted for 90 days - which means external users cannot view the transcript PDF. The transcript is available for review at the clerk's office or for purchase from the transcriber during this 90 day restriction period. When the 90 day restriction period ends, the transcript will be available via PACER and copies may be purchased at the clerk's office. The text event will be mailed to parties who are not e-filers and appeared at the hearing. The docketing of this event will trigger the issuance of a Notice of Electronic Filing (NEF) to electronic parties to the case. An attorney or pro se party is responsible for reviewing the statements made on behalf of the party and the testimony of any witnesses. An attorney who obtains the transcript from the court reporter or transcriber may obtain remote electronic access to the transcript through the court's CM/ECF system for purposes of creating hyperlinks to the transcript in court filings and for other purposes. The event sets a 90-day "Release Transcript" deadline. The event sets a Transcript90 flag. 2) Notice of Intent to Request Redaction: [Bankruptcy > Notices > Notice of Intent to Request Redaction (Private PDF)] Each party's attorney or pro se party is required to review a transcript for information that should be redacted under the Judicial Conference's privacy policy: Social Security numbers should be redacted to only the last four digits; birth dates should contain only the year of birth; individuals known to be minors should be referred to with initials; and financial account numbers should be redacted to the last four digits. Parties are to file a notice with the court of his or her intent to request redaction of such information from the transcript within seven (7) business days of the filing of the transcript. The event sets a 21-day "Statement of Redaction Due" deadline and a 31-day "Redacted Transcript Due" deadline. Statement of Redaction Requested Once a party has filed a Notice of Intent to Request Redaction, the request for redaction is due within 21 calendar days of the date the transcript was received or they must seek an extension to time to do so. The request for redaction specifies the items to be redacted. The filer is to serve the document by regular mail upon all parties at the hearing and the court reporter/transcriber and shall include a certificate of service listing the date and parties served. The PDF document attached to the event is restricted from the view of external users of CM/ECF. [Court Reporter/Transcriber> Redacted Transcript] The court reporter/transcriber has 31 days from the date the original transcript was filed to file the redacted transcript. Access to the original transcript and the redacted transcript will be restricted for the remainder of the 90 day restriction period. During the 90 day restriction period, the unredacted transcript and the redacted transcript are available for review at the clerk's office or for purchase from the court transcriber. When the 90 day restriction period ends, the redacted transcript will be available via PACER and copies may be purchased at the clerk's office. The unredacted transcript will remain restricted. When the 90 day restriction period ends, the clerk's office will remove the restrictions on the last version filed. The transcript is available via PACER and copies may be purchased at the clerk's office. |
