Motion to Approve Compromise or Settlement under Rule 9019

Note: When the settlement/compromise settles issues that relate to both an adversary proceeding and the main bankruptcy case, the same stipulation, motion and notice should be filed in both cases. See LR 7007-1(G).

Filing Requirements:

  • First file: Settlement Agreement

    Note: The settlement agreement is to be electronically filed before the motion, notice and certificate of service in order to ensure proper linkage of documents.

  • Trustee/US Trustee > Motion to Approve Compromise or Settlement under Rule 9019.

  • Notice of Motion giving 21 days to object. Notice is sent to all creditors.

  • Proof of Service

  • Proposed Order Instructions.


To File Electronically:

  1. Log into CM/ECF.

  2. Select [Bankruptcy > Trustee/U.S. Trustee].

  3. Enter the case number (e.g, xx-xxxxx).

  4. Select [Trustee/US Trustee > Motion to Approve Compromise under Rule 9019] from the event list.

  5. Skip the Joint Filing screen.

  6. Select the party filer.

  7. Enter a "y or n" if the notice and certificate of service are included with the motion.

  8. Enter date served.

  9. Browse to select the Motion (.PDF file).

    Note: The Motion, Notice of Motion, and Proof of Service may be a single PDF; or the Notice, supporting documents, and Proof of Service may be added as attachments to this document. The Motion must be the first document in your PDF.

  10. Modify the text as appropriate.

  11. Verify the final docket text; if correct, click [Next] to submit your document(s).

    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.

  12. Submit Proposed Order. Instructions

  13. Reminder: When the settlement relates also to an adversary case, docket the same settlement agreement/stipulation, then same Motion and Notice in the adversary proceeding.
