Always
read ECF screen notes when filing documents.
The only time
an attorney will file the Statement of Social Security Number
(Form B121) electronically is when it is AMENDED. This completed
and signed form should be kept in your file and produced if
requested.
Judge/Trustee
Assign pertains to Chapter 7 and Chapter 13 and must be done
the same day as the case is filed.
Use
ECF Search feature
to find an event.
Always double
check the case name and case number to be certain
you are filing the documents in the correct case.
Note:
If filing in main case, use bankruptcy case number;
if filing in an Adversary Proceeding, use Adversary Proceeding
Number. The
case number used determines where the document will be filed.
Remember to date
and type the signing person's name (i.e., John
Doe) on the signature line of all pleadings. DO NOT leave a blank line.
Always file the
main pleading first (e.g., Motion), preferably as one PDF
in this order: Motion, Notice,
and Certificate (if applicable).
The exception
to this is: a Modified Chapter 13 Plan or Stipulation/Settlement
Agreement are filed first
and then the Motion, Notice and Certificate are related the
filed Modified Chapter 13 Plan or Stipulation/Settlement Agreement.
When filing a
document that to a previously filed
document, the reference docket number must
be selected so document relates properly, such as:
Proof of Service (
to each
document(s) listed and mailed to parties).
Objection, Reply or Response ( to Motion only).
Objection to Confirmation of Plan ( to last Plan only).
Motion to Continue Hearing ( to Motion only, not
to the notice of hearing).
Motion to Continue Confirmation ( to the last Plan filed only, not
to the notice of hearing).
When browsing
for a document, always right click and open the document to
verify:
you are the
correct document to the entry.
the PDF image contains the complete document.
none of the pages are distorted (must be legible) or
missing.
the signature line includes the typed
signing party's name (i.e., John Doe) and is dated.
Preferably all
documents are in one PDF (i.e., Motion, Attachments, Notice
and Certificate of Service). However, if you are filing
a large number of , you can attach
each document to the same entry. You need to name each
attachment. At the first "Browse" attach the
Motion, Notice, and Certificate, then change "Attachments
to Document: to YES". Another browse screen appears.
Add each separate attachments one at a time and name
it in the Description field (i.e., Exhibit A, Memorandum of
Law, Brief). Also remember to right click and open the document
(see
#10 above). Click [Add to
List].
When amending
documents, always include a brief reason for amending in the
docket text.
If no fee is
required, remove the filing fee amount from field blank and
leave the receipt field blank. When the filing fee is exempt
pursuant to 28 U.S.C. Section
1930, then type EXEMPT in the receipt field. If "Trustee
only" requesting to defer a filing fee, then type DEFER
in the receipt field.
If a document
is filed electronically, do
not mail us the original document unless requested.
Do not file adversary
documents in bankruptcy cases. When filing electronically,
select the "Adversary"
category from the ECF menu. All
adversary filings should include the adversary caption and
adversary case number. The
case number used determines where the document will be filed.
Proposed orders
must
be in Word format and attached to an email and sent to proposed_orders@ndb.uscourts.gov.
Please insert the case number and the last name of the debtor(s)
in the subject line.
